Helping You With the Equitable Division of Marital Property
I will help you equitably distribute all property obtained during the course of your marriage, if the property has not been received by inheritance or gift to you or your spouse. This includes real and personal property, bank accounts and investments, retirement funds and business assets.
I will work closely with you to try to iron out a property settlement without the intervention of the court. As a general rule, you and your spouse can agree to divide the marital property as you see fit, and the court will not question whether it is "equitable." However, if you cannot agree and must go to court, the court will compile an inventory of all marital property and divide the assets in a way that it determines to be fair. This can include the transfer of money or property from one spouse to the other to balance the distribution.
Often, the court will be influenced by the property settlements found in the separation agreement. Accordingly, it is important to carefully consider property issues when negotiating a separation agreement.
What About Marital Debt?
Clients often have questions about the division of marital debt. Technically, there is no such thing as marital debt. Any financial obligations remain in the name of the person in whose name the debt was incurred. For example, credit card debt will remain in the name of the person on the account, regardless of who charged the items. If debt, such as a mortgage or personal debt, is legally in the names of both parties, then both parties will be responsible for the entire amount of the debt.
Nonetheless, either party can still agree to assume a debt of the other party. I will help you work to negotiate a fair distribution of all marital debt.
